Big Z's Habitats and Arachnids — Terms of Service

By browsing this site or placing an order you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the site. We may update these Terms from time to time; the version posted here at the time of your order applies to that order.

1. Who We Are

Big Z's Habitats and Arachnids ("Big Z's", "we", "us") sells live invertebrates, enclosures, keeping supplies, starter kits, and educational care guides, and is based in Phoenix, Arizona, USA. Contact: bigzshna@gmail.com.

2. Eligibility & Age

You must be at least 18 years old to buy a live animal from us, or have the involvement and permission of a parent or legal guardian who accepts responsibility for the animal and these Terms. Animals we rate higher on our Spice scale — including venomous or medically significant species — are sold only to experienced adult keepers. We may decline or cancel any order at our discretion.

3. The Spice Rating Is Guidance, Not a Safety Guarantee

Our 1–5 "Spice" rating is our own opinion of how demanding or hazardous an animal is to keep, offered to help match animals to keepers. It is not a guarantee of safety, temperament, or outcome. Every invertebrate is an individual; some can bite, sting, urticate (kick hairs), or cause allergic reactions. You are responsible for researching any animal before you buy it.

4. Legality Is the Buyer's Responsibility

Laws on keeping invertebrates vary by state, county, and city, and some species are prohibited in some places (for example, many invertebrates cannot be shipped to Hawaii). It is your responsibility to confirm that the animal you order is legal to own and import at your address before you order. If we learn an order would violate the law at the destination, we may cancel it. We are not liable for your failure to comply with applicable laws, and orders refused, seized, or returned for legal reasons are not covered by the Live Arrival Guarantee.

5. Assumption of Risk — Live Animals

Keeping invertebrates carries inherent risks, including bites, stings, venom reactions, allergic reactions, escapes, and property damage. By purchasing a live animal you knowingly and voluntarily assume all such risks for yourself and members of your household. You agree to house animals securely and responsibly and to seek appropriate medical attention if needed. To the fullest extent permitted by law, Big Z's is not liable for any injury, illness, death, allergic reaction, or property damage arising from an animal after it has been delivered to you.

6. Care Guides & Support

Care guide PDFs and any direct-message support from Big Z are provided as general educational information only. They are not veterinary advice and come with no guarantee of any particular result. Always use your own judgment and consult a qualified exotics veterinarian for health concerns.

7. Orders, Pricing & Availability

We try to keep listings, photos, and prices accurate, but errors happen. We may correct errors, change prices, limit quantities, or cancel orders (including after an order is placed) — if we cancel an order you have already paid for, we will refund it. Animals are living inventory; the exact individual you receive may vary in size, color, and markings from photos. Receipt of an order confirmation is not acceptance of your order; we accept an order when we ship it.

8. Shipping, Returns & the Live Arrival Guarantee

Shipping is governed by our Shipping Policy and returns and DOA claims by our Refund & Return Policy, both of which are part of these Terms.

9. Acceptable Use

Do not use the site to break the law, infringe anyone's rights, resell our content, scrape or attack the site, or misrepresent yourself. We may suspend or refuse service to anyone who does.

10. Intellectual Property

The text, photos, care guides, logos, and design on this site are owned by Big Z's or used with permission and may not be copied or redistributed without our written consent.

11. Third-Party Links

Links to other sites are provided for convenience; we do not control and are not responsible for their content.

12. Disclaimers & Limitation of Liability

Except for the Live Arrival Guarantee expressly stated in our Refund & Return Policy, the site, products, and content are provided "as is" without warranties of any kind, to the fullest extent permitted by law. To the fullest extent permitted by law, Big Z's total liability for any claim relating to an order is limited to the amount you paid for that order, and we are not liable for indirect, incidental, special, or consequential damages.

13. Indemnification

You agree to indemnify and hold harmless Big Z's from claims, damages, and expenses arising out of your violation of these Terms, your violation of any law, or your keeping or handling of an animal after delivery.

14. Governing Law

These Terms are governed by the laws of the State of Arizona, USA, without regard to its conflict-of-laws rules, and the courts located in Maricopa County, Arizona will have jurisdiction over any dispute, except where applicable consumer-protection law provides otherwise.
